Credit Cards

We accept the following credit cards: Visa, American Express, MasterCard, and Discover & PayPal. There is no surcharge for using your credit card to make purchases. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order. Your credit card will be billed upon shipment of your order. Your order is authorized when you check out, the final amount may vary when the order is shipped due to out of stock items.

Multiple Product Orders

For a multiple product order, we will make every attempt to ship all products contained in the order at the same time. Products that are unavailable at the time of shipping will be shipped as they become available, unless you inform us otherwise. You will only be charged for products contained in a given shipment, plus any applicable shipping charges. You will only be charged for shipping at the rate quoted to you on your purchase receipt. The entirety of this shipping charge may be applied to the first product(s) shipped on a multiple shipment order.

Order Acceptance Policy

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. BioWOW Foods, LLC reserves the right at any time after receipt of your order to accept or decline your order for any reason or to supply less than the quantity you ordered of any item.

Out-of-Stock Products

We will ship your product as it becomes available. Normally, orders received before 1:00 PM EST ship the same day. Other orders normally ship within one business day of receipt. Exceptions to this schedule may occur on the day following a three-day weekend and during the weeks of the Christmas season.. However, there may be times when the product you have ordered is out-of-stock which will delay fulfilling your order. We will keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment. You may cancel your order at any time prior to shipping. Adding products to your order can delay your order and since your order has been authorized for the prior amount, BioWOW Foods, LLC requires your credit card to add additional items to your order.

We keep your personal information private and secure. When you make a purchase from our site, you provide your name, email address, credit card information, address, and phone number. We use this information to process your orders, to keep you updated on your orders and to personalize your shopping experience. Returns & Refunds

If for any reason you are not completely satisfied with any BioWOW Foods product purchased directly from BioWOWFoods.com, you may return it within 60 days from your ship date for a full refund or product exchange. If 60 days has passed since your purchase has shipped, we apologize, but we cannot accept the item(s) for a return.

Broken or Incorrect Items

I’ve received a broken or incorrect item: Sorry about that… We’re doing our best to fulfill your needs as efficiently as possible. Please see additional info on returns below… Note that shipping fees for returned items that aren’t broken or incorrect are non-refundable. You may keep and be refunded for any opened or unopened product within 60 days of the purchase date. If you ordered more than 1 item, only 1 of those items may be kept, all other items must be sealed and returned. Once your return is received, you will receive your refund in the original form of payment. Shipping costs are not refundable. It will be the responsibility of the purchaser to provide a return label. We recommend using insured/trackable mail for these types of returns, as we are not responsible for item(s) that do not make it back to us, and you will not be refunded unless they are safely returned.

Limitation of Liability

In no event shall BioWOW Foods, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services or products provided by BioWOW Foods, LLC; (ii) any conduct or content of any third party; (iii) any content obtained; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Taxes

BioWOW Foods, LLC shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the same state (Oregon). For orders shipped to other states, you are solely responsible for all sales taxes or other taxes.

Typographical Errors

In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, BioWOW Foods, LLC shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. BioWOW Foods, LLC shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, BioWOW Foods, LLC shall immediately issue a credit to your credit card account in the amount of the incorrect price.

Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Oregon, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our services and products, and supersede and replace any prior agreements we might have between us.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our products after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the services and products we offer.
